SMS Terms

These SMS Terms describe how Listing Stack LLC ("ListingStack," "we," "us") uses text messaging as part of the ListingStack service, your consent to receive text messages, and your right to opt out. These SMS Terms are part of our Terms of Service and should be read alongside our Privacy Policy.
1. Overview
ListingStack uses SMS in three ways:
- Transactional alerts to agents — ListingStack may text you, a ListingStack account holder, about activity on your account (new inbound leads, deal milestones, system notices).
- Outbound messages agents send to their contacts — you (the agent) may use ListingStack to send text messages to contacts stored in your account. You are the sender of those messages and remain responsible for compliance with applicable law.
- Two-way conversations — when a contact replies to a message sent through ListingStack, we receive and route the reply to the sending agent within the application.
2. Consent
For agent-facing transactional alerts: by providing your phone number to ListingStack and leaving SMS notifications enabled in your account settings, you consent to receive text messages from ListingStack related to your account. Consent is not a condition of purchase.
For messages agents send through ListingStack: ListingStack will only deliver outbound messages to recipients who have given the sending agent valid express consent, as evidenced by contact-level opt-in collected by the agent before the message is sent. ListingStack enforces a contact-level opt-in check before outbound messaging is enabled for a given recipient.
For two-way replies: by replying to a message sent through ListingStack, the recipient consents to further communication at that number in that conversation until they opt out.
3. Types of messages
You may receive messages that include:
- Notifications about new inbound leads on your public agent site
- Deal-stage updates and task reminders
- Account and security alerts
- Billing notices (for paid plans)
- Service-availability notices
Recipients of messages agents send through ListingStack may receive real-estate communications including listing updates, appointment reminders, showing confirmations, transaction milestones, and other messages directly related to the agent-client relationship.
4. Message frequency
Transactional alerts are event-driven, typically fewer than 10 messages per month, depending on your activity. Messages agents send to their contacts are sender-controlled and varies by agent and use case.
5. How to opt out
You can opt out of any SMS messaging at any time. Reply STOP (or any of these variants: CANCEL, END, QUIT, UNSUBSCRIBE) to any message. You'll receive a single confirmation message and no further messages unless you opt back in.
Agents can also disable SMS notifications in their ListingStack account settings. Contacts receiving messages from an agent can also request opt-out directly from the agent.
6. How to get help

7. Message & data rates
Message and data rates may apply. ListingStack does not charge you for receiving SMS, but your mobile carrier may charge for messaging based on your plan. Check with your carrier if you're unsure what applies.
8. Carriers
We deliver SMS via Twilio. Supported U.S. carriers include AT&T, T-Mobile, Verizon, Sprint, Boost, Cricket, MetroPCS, and U.S. Cellular, among others. Wireless carriers are not liable for delayed or undelivered messages.
9. Eligibility & geographic scope
SMS features are available to U.S. mobile numbers only. Messaging is subject to A2P 10DLC registration and carrier approval. International messaging is not currently supported.
You must be at least 18 years old to consent to receive SMS from ListingStack.
10. Privacy
We handle phone numbers and SMS content in accordance with our Privacy Policy. We do not sell phone numbers or SMS content, and we do not share SMS opt-in data with third parties for their own marketing. Twilio, our SMS provider, processes messages on our behalf under a written processor agreement.
11. Agent obligations
If you are a ListingStack account holder who uses the Service to send messages to your contacts, you represent and warrant that:
- You have obtained valid express written consent from each recipient before sending any marketing or solicitation SMS, in compliance with the Telephone Consumer Protection Act (TCPA) and any applicable state laws.
- You maintain records of consent and make them available to us if we request them in connection with a carrier or regulatory inquiry.
- You will honor opt-out requests promptly, regardless of how the recipient communicates them.
- You will not use ListingStack SMS to send messages that are misleading, deceptive, harassing, or otherwise unlawful.
- You will comply with all real-estate-industry communication rules that apply to your practice (including state licensing rules, fair-housing laws, and recordkeeping requirements).
You indemnify ListingStack for any claim, damage, or penalty arising from your failure to meet these obligations, as described in our Terms of Service.
12. Changes
We may update these SMS Terms from time to time. Material changes will be posted here with a new "Last updated" date, and account holders will receive notice.
